Mangochi First Grade Magistrate Court on Monday June 12, 2017 convicted and sentenced 25 year old Rwandan national,Rukundu Amiabo to a fine of one million and two hundred thousand kwacha in of default 96 months Imprisonment with Hard Labour (IHL).
The sentence is for an offence of reckless driving contrary to section 126(1)4(b) of the Road Traffic Act.
Sub lnspector Maxwell Mwaluka, a prosecutor based at Mangochi Police Station told court that on May 27, 2017, the accused person was driving a Toyota Hilux Pickup registration number BS 3707 from the direction of Mangochi boma heading to Monkey-Bay with six passengers on board.
Mwaluka further presented before the court that, upon arrival at St. Augustine 3 Primary School, due to speeding, the accused lost control of the motor vehicle hence he swerved to the extreme other side of the road where he hit a pedal cyclist who was cycling opposite direction and had a pillion passenger.
The prosecutor added that, following the impact all six passengers fell down from the moving motor vehicle. The passengers, the cyclist and pillion passenger sustained deep cuts on the head and multiple bruises on both legs and were rushed to Mangochi District Hospital for treatment.
The accused person escaped with minor injuries and his motor vehicle had its both near and offside view mirrors broken.
The accused person pleaded guilty as charged, in his mitigation he begged leniency from the court but the prosecutor pleaded for a stiffer penalty.
In his submission, his worship First Grade Magistrate Ronald M’bwana concurred with the state prosecutor as the accused person did not follow road safety measures and also for endangering alot of people’s lives.
Hence he fined him to a sum of K1.2 million in default of 96 months imprisonment with hard labour in order to serve as a lesson to others who drive recklessly. The accused person paid the whole amount in cash.
Rukundu Amiabo comes from Rwanda but currently resides and do business at Ntanga Village in the area of Traditional Authority Chimwala in Mangochi.
