Mangochi Magistrate Court has sentenced a 27-year old Atibu James to 8 years Imprisonment with Hard Labour (IHL) for defilement contrary to section 138 of the penal code.
According to Mangochi Police Deputy Public Relations Officer Amina Tepani Daudi, James defiled his 6-year old niece (name withheld) when he visited relatives at Katuli area in the district.
Daudi reported that the accused asked the victim and her young brother to escort him as he was leaving the village but ended up satisfying his uncontrollable sexual desire on the young girl.
Information indicate that the victim’s mother got suspicious after noting that her daughter was just dressing properly on return from escorting his uncle. Then the mother discovered that her daughter was defiled.
The matter was reported to Katuli Police Unit and medical results at Katuli Health Centre confirmed occurrence of sexual abuse which led the police to arrest the suspect.
The suspect pleaded not guilty before the court but the court paraded witnesses to convict him.
The convict pleaded for leniency while the state side asked for a considerable punishment looking at how the cases of defilement are rising in the district.
Passing his judgment, magistrate Ronald M’bwana concurred with the state side and slapped the offender with 8-year IHL sentence.
