Mangochi Magistrate Court has convicted and fined Joseph Mtambo to pay MKW 200, 000 in default of 36 months imprisonment with hard labour for an offence of grievous harm contrary to section 238 of penal code.
According to Mangochi Deputy Public Relations Officer Amina Tepani Daudi, the convict found out that the complainant, Jacob Nambo, was in a love affair with his wife.
The court heard Nambo was tricked to meet Mtambo’s wife one night where he was assaulted by Mtambo getting seriously injured in the process.
The court found Mtambo guilty of grievous harm.
State Prosecutor Sub Inspector Grace Mindozo pleaded with the court to pass a stiff punishment considering that the complainant’s eye got permanently disfigured.
However, passing his sentence, Second Grade Magistrate Augustine Mizaya told the court that Mtambo deserved leniency bearing in mind that there was provocation from Nambo.
Joseph Mtambo hails from Mpinganjira 2 Village in the area of Traditional Authority Chimwala in the district.
