Mangochi First Grade Magistrate Court on June 07, 2017 convicted and sentenced 56 year old Yasin Sumani to 5 years years lmprisonment with Hard Labour for an offence of defilement contrary to section 138(1) of penal code.
Sub lnspector Maxwell Mwaluka, a Prosecutor based at Mangochi Police station told court that, on January 01, 2017 the victim aged 12 years (name withheld), was left at home with accused person who works as a gardener when her parents went to church.
Then she went to the toilet to answer the call of nature, as she was there the accused person followed her into the toilet.
The prosecutor added that, when the girl requested Suman to wait outside but just he beat her up with a walking stick then covered her mouth with his hands in order for her not to shout then sexually abused her as she was already undressed.
The convict also threatened to kill her if she reveals the incident to anyone.
However, few days later she revealed to her parents who reported the matter to Mangochi Police station where medical report was issued and also arrested the offender.
The results from Mangochi District Hospital confirmed that the girl was sexually abused.
In his mitigation, the Sumani, who pleaded not guilty, begged for leniency from the court as he is a bread winner to his family while the prosecutor pleaded for a stiffer penalty.
Passing the judgement, His Worship First Grade Magistrate Ronald M’bwana found the accused guilty guilty to the charge.
M’bwana expressed his concern over the accused person’s conduct of which he described as inhumane.
The then slapped him with 60 months (5 years) Imprisonment with Hard Labour.
Yasin Sumani hails from Mtalimanja Village in the area of Traditional Authority Mponda in the district.
