Man Jailed for defilement

Mangochi First grade magistrate court has convicted and sentenced Jowart Chitseko to 9 years imprisonment with hard labour for defiling and impregnating  a 15year old girl contrary to section 138 of the penal code.

Mangochi Police prosecutor station prosecutor lnspector Efford Kamphonje told the court that accused person On the afternoon of January 19, 2018 the victim left her home and went to see her brother at his work place at Njereza cement factory in the district.

Upon arrival she met and asked for directions from the accused person who also works there.

As she was going back home, the accused person escorted her but then took her to his house in Malembo.

Few days later her mother was surprised as she expected her child to return home the same day. The victim’s brother was also surprised when his mother called to inquire on his sister’s whereabouts.

Later they reported the issue at Makokola Police Unit. Two weeks after the complaint was lodged, the police found the victim at the accused person’s house following a tip from members of the general public.

The victim narrated in the court that she was being defiled everyday and the Police issued her a medical report.

Medical examination results from from Mangochi District hospital confirmed that the teenager was repeatedly defiled and that she is two weeks pregnant.

Appearing in court the accused person pleaded guilty to the charge.

In his submission before sentence lnspector Kamphonje asked court to impose a custodial sentence since the victim was being molested despite the government and other stakeholders fighting for the protection of girls from various forms of abuse.

When passing judgement his worship first grade magistrate Ronald M’bwana concurred with the state hence sentenced him to a 9 year jail term In order to serve as a lesson to him and other would. be offenders.

Jowart Chitseko of 28 hails from  Simoni village in the area of traditional authority Nankumba in Mangochi district.
