The Mangochi first grade magistrate court on Friday April 7,2017 convicted and sentenced Lloyd Mtambalika to spend four years with hard labour for committing three crimes ,Breaking into a Building and Committed felony therein ,Burglary/ Theft and Escaping from custody contrary to sections 311(1), 309(1) and 115 of penal code.
The court learnt from sergeant Mc Anthony Phiri a prosecutor based at Monkey-Bay Police Post that, on the night of January 27,2017 ,Mtambalika broke into Chikondi Timothy’s shop which is at Malembo Trading Centre and went away with assorted clothes worthy K200000.00. The police arrested him the following day being found selling the stolen items at the same trading Centre, while kept at Malembo Police Unit,he escaped from lawful custody by breaking the door of the cell.
The Prosecutor further said that, after being on the run for few weeks Mtambalika along with his friend broke into Samuel Michael’s house and went away with various items including Samsung Home theater and sub woofer worthy K210000.00. On February 27,2017 he arrested again at Namadzidzi Depot with a sack bag containing some of the stolen items. The Police charged him with the already mentioned 3 charges.
Mtambalika was pleaded not guilty to all charges and the state paraded five witnesses. In his mitigation he begged court for a suspended sentence however the Prosecutor pleaded for a stiffer punishment.
When passing judgement his worship first grade magistrate Ronald M’bwana found him guilty to all charges laid against him and he sentenced him to four years imprisonment with hard labour.
Mtambalika hails from Yesaya village Tradtional Authority Nankumba in Mangochi District.
