Monkey-bay third grade magistrate court on friday convicted and ordered a 51 year-old driver Lupi Mwanjasi to pay a fine of K290,000-00 for causing death by reckless driving.
Monkey-bay Police prosecutor Sub lnspector Laston Sabola told the court that, On the afternoon of new year’s eve, Mwanjasi was driving a Nissan vannet registration number NE4469 from the direction of Monkey-bay heading Mangochi boma.
Upon arrival at Nsumbi trading centre due to speeding he collided and ran over a motorcyclist who was riding from the left crossing to the right hand side of the road.
Due to the impact, the motorcyclist Josophat M’dala 57 of Mtewa, Traditional Authority Nankumba in Mangochi ,sustained multiple fractures on the right arm and leg and died while receiving treatment at Mangochi District Hospital.
The motorcycle got extensively damaged whilst the motor vehicle had it’s front part completely damaged.
Appearing in court the accused person pleaded guilty to the charge laid against him.
In mitigation he begged for a leniency however the prosecutor prayed for a stiffer penalty.
When passing judgement his worship third grade magistrate Samuel Kasile concurred with the state hence ordered him to pay a fine of K290,000 in default 24 months imprisonment with hard labour in order to serve as a lesson to him and other would be offenders. If paid the bereaved family will receive K100,000 as compensation.
Lupi Mwanjasi hails from Mwanjasi village in the area of Traditional Authority Kilipula in Karonga.
